Your rights during an ICE raid at work: step-by-step guide for workers and employers
Your Rights at Work
Every worker in the United States has constitutional rights, regardless of immigration status. These rights apply during any interaction with immigration agents.
Before a Raid Happens
- •Know your workplace layout and exits
- •Have emergency contacts memorized
- •Keep important documents in a safe place at home, not at work
- •Know who your designated workplace representative is
During a Workplace Raid
If ICE agents arrive at your workplace: • Stay calm - do not run • You have the right to remain silent • Ask if agents have a judicial warrant (not just an administrative warrant) • Do not sign any documents without an attorney
Judicial vs Administrative Warrants
- •A JUDICIAL warrant is signed by a judge and allows agents to enter
- •An ADMINISTRATIVE warrant (Form I-200, I-205) does NOT allow entry without consent
- •You can ask to see the warrant through a window or under the door
For Employers
Employers should: • Require agents to present a judicial warrant before allowing entry to non-public areas • Allow employees to leave if they wish (if not specifically named in a warrant) • Document everything that happens • Contact an attorney immediately
After a Raid
- •Document everything you witnessed
- •Contact an immigration attorney
- •Report the incident to local advocacy organizations
- •Check on coworkers and their families
